Ripped off by COBRA RED

Three of the four tires COBRA RED sold me have a portion of the steel cord exposed where the tire seals to the rim... The guy (Dwayne) that sold them to me said that they will still seal and that the tire shops have something to make them work... no big deal. Well that couldn't be further from the truth. The tire shop said that not only will the tires not seal properly, but they would also damage the wheel I place them on along with possibly blowing out on the road if I were to use them.

I have made multiple attempts at contacting this guy, and now this guy is blowing me off knowing that he lied to me about their usability and he is probably thinking he can easily screw me out of the $260 I paid for them.

I am currently separated and don't have that kind of money to just throw away. So this puts me in a position of being forced to take legal action against him to recover my money unless he calls me back to make good on this bad purchase.

I'm also going to make contact with Bandit to see what information he can get for me on this guy!!!

Do you have pictures of the tires ? Remember you are taking the word of a tire shop that might or might not being trying to sell you a set of tires themself .

So get this... I just remembered where he told me he worked, so I looked up the number and called him that way.

Dwayne Kiser stated the following:

"I do not sell bad parts, I had these on my coupe for a while before wanting to sell off the wheels I had on my car, they seal fine and ran without problem." (When he sold the tires to me he stated these tires had maybe a hundred miles on them and the damage occurred when they were removed from his wheels. He stated he checked them by mounting them on one of the other wheels he had for sale without showing any leaks.)

He declined my request for reimbursement because he stated them to be sold "As Is" all the while declaring his honest practices. I asked him how honest could he be by declining my request if there is a problem with the part? He responded with some of the ways he felt that he had been ripped off through some of his purchases.

Dwayne Kiser asked me where I took them for installation, I told him Discount Tire. He said they were lying to me because they wanted to sell me new tires. Discount Tire never once made that offer and they were already prepared to put the older tires I already had on my Stang back on these new wheels I bought there.

Dwayne Kiser wanted me to take the tires somewhere else to have the tires checked, so I told him that I would look at what Firestone would offer in respect to a warranty on these tires and then see if there would be any additional costs I would incur if Firestone were inclined to warranty them. I will also ask the guys at Firestone if they feel as though these tires are fully mountable without any issue as they sit, I'm guessing I will know what the answer will be. Dwayne Kiser then asked me to call him after that is done to let him know where things stand... does this mean he will entertain reimbursement to me!? I can only hope so... We'll see!!!

I am not trying to defend anyone here or take a side but please keep in mind that there is always two sides to every story . I spoke to Duwayne about 45 minutes ago and he said you looked at the tires for a very long period of time before buying them . If that is the case then its just as much your fault as anyone elses . If you do not have in writing some kind of guarantee from him on the tires , you really have no legal recourse either .

You bought them as is and made that decision on your own based on what you seen when you bought the tires . Its always buyer beware in those types of situations .

As said above , you really need to take the time to post pictures of the damage instead of spending that time whining about it . It will either make your case that much stronger or dismiss it completely . There are enough experienced board members on here that can give you an unbiased opinion on whether they will work or not as long as you have good pictures .

hate to tell ya bud but they are right. if you looked over the tires and handed over the money, its all on you. you could have seen the wires and waled away from the deal. i could see u have an issue if these where shipped. but this was a face to face transaction.

If this is true, then Dwayne should have no problem returning the money. Unfortunately people tend to trust other board members and believe them. If I sold something that was junk, I would feel bad and refund the transaction.

yeah man, not trying to take a side here either but ive been to court or been witness many times before and this to most judges would be written or as hear/say if there is no concrete (paper, voice recording, emails, etc) evidence against him stating a guarantee as mentioned above...just try to work something out man but who knows how it may turn out...its happened to me before too i bought a saleen wing from somebody and it ended up not being what i thought but it was my fault for not checking, now im stuck with it...
