waiting period

so kristen(my girlfriend) turned 21 today and she went to go buy some beer at a shell station tonight and they wouldnt sell it to her??? the guy said that by Texas Law they have to wait like a day after her birthday to sell her alcohol? which doesnt make sense cuz we were at chilis earlier today and they sold to her no problem?? do any of yall know anything about this??????

I've heard of it before in the club scenes...like someone will walk up after midnight with an ID that "technically" states they are 21 now, however they are still marked as a minor for that night. Ive seen a lot of arguements over it but never really looked into it myself to know if its actual law, or just a general guideline. from what i know though they are still protected by the "refuse service to serve anyone" signs they have on the doors, but its still bull...

Yeah, like if you go to somewhere after midnight of the 19th because ur b-day is the 20th, I think a lot of places will give you crap. But if you went just at night on the 20th, they can't really say anything. It's like even though the day has technically changed... the "night" hasn't, so it's not a new day until they close and open again. I know it's confusing, but u get what I'm saying?

yeah i saw it all the time, but these were big clubs and usually TABC was there at the door with them so rules were rules...crazy thing is that the place they are probably talking about is probably not a million dollar place that can just turn people away...seriously what 21 year old is going to call the state and complain cuz they were sold alcohol on their 21st birthday?

When Terrah turned 21 we went out the night before her birthday in Dallas and they made us come back at midnight so she could get in as an adult.... Kinda backwards from what everyone else on here has said...

lol the store was a shell gas station on the corner of jones maltsburger and starcrest... the guy was all nerdy looking lol we thought about going back tonight and getting a lot of shit and being difficult to mess with him but a friend of mine told me last nite that its legit... we went to a couple restaurants last nite and they sold to her but at that one gas station they wouldnt sell to her. lol we ended up at bostons last nite and all my buddies were buying her shots and she is DEFINATELY feeling it this morning haha

There is no waiting period. 21 is 21. And you are 21 after midnight on the day of your birthday.

There was a proposed bill some time ago but it never passed.........

HB 36 – Author, Rrep. Rrob Eissler, Rr-The Wwoodlands

Also known as the “Cinderella Bill”, this bill would make it a Class A misdemeanor if an alcoholic beverage is sold, served, dispensed, or delivered to a person before 7:00AM on their 21st birthday. The bill is designed to stop the binge drinking that occurs between the hours of midnight and closing time (usually 2:00AM) when a person turns 21.

Actions: This bill failed to receive an affirmative vote in committee.
